Terms of Use

Last updated:

These terms apply to your use of the Againday app and the againday.com website (together, the “service”). By using the service you agree to them. If you don’t agree, please don’t use the service.

1. Using Againday

We grant you a personal, non-exclusive, non-transferable license to use the Againday app on devices you own or control, for your own personal, non-commercial use, in line with these terms and the rules of the store you downloaded it from.

2. Your account

You can use Againday without signing in; the app creates an anonymous account for you. If you sign in with Apple or Google, you are responsible for keeping access to that account and your devices secure. Please use a display name that isn’t misleading or offensive, because the people in your shared lists will see it.

3. Your content

The items, lists, notes and records you create belong to you. You give us permission to store, copy, sync and display your content only as needed to run the service for you — for example, to sync it between your devices and to show shared lists to their members. We don’t use your content for anything else.

You are responsible for what you put into Againday. Don’t store information you aren’t allowed to share, and remember that everyone in a shared list can see its contents.

4. Shared lists

The owner of a list decides who is invited and can remove members at any time. Members with edit access can add, change and delete items and records in that list. Anyone who has an invite link or code can join until it expires or is cancelled, so only send invites to people you trust. We are not responsible for what other members do in a list you share with them.

5. Acceptable use

Please don’t:

  • use the service for anything unlawful, or to harass or harm others;
  • try to gain unauthorized access to the service, other people’s data or our systems;
  • interfere with or overload the service, including through automated access, scraping or spam invitations;
  • copy, modify or reverse engineer the app except where the law allows it.

6. Free version and Againday Pro

Againday is free to use for up to 3 items of your own, with all features included. Items in lists that others share with you don’t count toward this limit. Againday Pro removes the limit.

  • Againday Pro is a one-time purchase. It is not a subscription and does not renew.
  • The price is shown in the App Store or Google Play before you buy and may vary by country.
  • Purchases are processed by Apple or Google under their terms. Refunds are handled by them according to their policies.
  • Againday Pro is tied to the store account you bought it with. You can restore it on your other devices that use the same account. On the App Store, Againday Pro can be shared with your Family Sharing group if you turn that on.
  • If you go back to the free version or your purchase is refunded, none of your data is deleted; you just can’t add more than the free limit of items.

7. Reminders

Reminders are a convenience. Notifications can be delayed or not delivered because of your device settings, battery saving, the operating system or other reasons beyond our control. Please don’t rely on Againday as the only reminder for anything where missing it could cause harm, such as medication, medical care, or safety-critical maintenance.

8. Availability and changes

We work to keep the service running, but we can’t promise it will always be available or free of errors. Syncing depends on your internet connection and on third-party providers. We may change, add or remove features. If we ever decide to stop the syncing service, we will give you reasonable notice in advance so you can export your data.

9. Disclaimer

To the extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, profits or opportunities, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid for Againday Pro in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or removes rights you have as a consumer under the laws of the country where you live.

11. Ending your use

You can stop using Againday and delete your account at any time from the app’s Settings. We may suspend or close accounts that seriously or repeatedly break these terms, or where required by law. Sections 3, 9, 10 and 13 continue to apply after your use ends.

12. App Store and Google Play

If you downloaded Againday from Apple’s App Store, you also agree to the following:

  • These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
  • If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Againday from Google Play, the Google Play Terms of Service also apply to your purchase and download.

13. Governing law

These terms are governed by the laws of Taiwan, without regard to its conflict-of-law rules. Disputes will be handled by the competent courts of Taiwan, unless the consumer protection laws of the country where you live give you the right to bring proceedings in your local courts or under your local law.

14. Changes to these terms

We may update these terms from time to time. We will change the date at the top, and for significant changes we will let you know in the app before they take effect. If you keep using the service after the changes take effect, you accept the updated terms.
